In late 2017, Bank of America settled the lawsuit and agreed to pay $66 million in damages to the plaintiffs. The court approved the settlement. Bank of America also agreed to make a fundamental change to its extended overdraft policies.
From the settlement, $37.5 million out of $66 million were paid to the customers. The remaining $29.1 million were used to cover charges against customers whose accounts were closed.
