Consumer Files Class Action against Commercial Bank NA

In June 2018, Jeffrey Douglas Kaliel began representing Eileen Weingart in a class action suit against Commercial Bank NA for improperly charging nonsufficient fund (NSF) fees.

The 22nd Judicial Circuit Court in St. Louis is hearing the class suit, in which Weingart alleges that Commercial Bank NA is charging NSF fees for a single transaction more than once. In her complaint, Weingart said Commercial Bank NA has breached its contract and its covenant of good faith and fair dealing.

Weingart’s complaint covers many small-dollar transactions she made from November 2017 to April 2018 through her checking account with Commercial Bank NA and her PayPal account. Each time Commercial Bank NA rejected her payment request for transactions made against insufficient funds, the defendant debited her account the amount of $37 as an NSF fee. However, when the same transaction was processed a few days later, Commercial Bank NA charged the account $37 again as an NSF fee.

Represented by the law firms Consumer Protection Legal LLC and Kaliel PLLC, Weingart seeks a trial by jury to claim restitution of all improperly charged fees, including interest, attorneys’ fees, compensatory damages, and other relief as the court sees just and fit. Weingart says that when the court approves her motion to certify the lawsuit as a class action, others who have been similarly charged may also receive restitution.
